You can not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.

In regards to all virtual goods and services IGXP.com is only providing a service to buyer, e.g. time/effort and resources we spent in providing gaming service, (the fee we charge is for the time/effort and resources we spent in delivery/mailing/transferring from one a/c to another of the characters, items and/or credits). No goods or ownership of intellectual property are being sold to buyer from IGXP.com. All registered names and trademarks are properties of their respective owners, (e.g. World of Warcraft is a trademark of Blizzard Entertainment). All characters, items and credits in the games (e.g. World of Warcraft) are the property of their respective owners (e.g. Blizzard Entertainment, Battle.net, Sony Online Entertainment Inc., Sony Computer Entertainment America Inc., NCsoft Corporation, Lucasfilm Entertainment Company Ltd., Square Enix CO., LTD., etc.). Indemnification. User/Buyer wholly assumes all risks and agrees to defend, hold harmless, and indemnify IGXP.com for any claims made by their respective owners and others in relation to this transaction and the use of respective intellectual property. IGXP.com cautions buyer to avoid violating or infringing upon the intellectual property rights of their respective owners. At IGXP.com's request, you agree to defend, indemnify and hold harmless of IGXP.com, its shareholders, partners, affiliates, directors, officers, employees, agents or suppliers, its licensees, distributors, Content Providers, and other Members of the Service, from all damages, liabilities, claims and expenses, including attorneys fees and costs, arising from any breach of any Agreement by you.
Restricted Users. If you are way, shape, or form affiliated with Blizzard Entertainment, Sony Online Entertainment Inc., Sony Computer Entertainment America LLC., NCsoft Corporation, Lucasfilm Entertainment Company Ltd., Square Enix CO., LTD., Microsoft Corporation, you cannot access to IGXP.com, use services provided by IGXP.com or purchase from IGXP.com or this website by any method. If you enterIGXP.com or any sub-domains you are in violation of code 431.322.12 of the Internet Privacy Act signed by President Bill Clinton in 1995 and therefore CANNOT threaten our ISP(s) or any person(s) or company storing these files, and cannot prosecute any person(s) affiliated with this Site/pages, including but not limited to family, friends or individuals who maintain or enter IGXP.com.
Limitation of Liability. THESE TERMS AND CONDITIONS APPLY (i) UNLESS THE CUSTOMER HAS SIGNED A SEPARATE FORMAL PURCHASE AGREEMENT WITH IGXP.com, IN WHICH CASE THE SEPARATE AGREEMENT SHALL GOVERN; OR (ii) UNLESS OTHER IGXP.com STANDARD TERMS APPLY TO THE TRANSACTION.
These terms and conditions are subject to change without prior written notice at any time, in IGXP.com's sole discretion.
Other Documents. Other than as specifically provided in any separate formal purchase agreement between Customer and IGXP.com, these terms and conditions may NOT be altered, supplemented, or amended by the use of any other document(s).

Payment Terms; Orders; Quotes; Interest. Terms of payment are within IGXP.com's sole discretion, and unless otherwise agreed to by IGXP.com, payment must be received by IGXP.com (to IGXP.com nominated account/s) prior to IGXP.com's acceptance of an order. Payment for the products to be made by credit card, wire transfer, bank transfer, direct bank deposit to IGXP.com nominated account or other prearranged payment method unless credit terms have been agreed to by IGXP.com. Orders are not binding on IGXP.com until they accepted by IGXP.com. Any quotations given by IGXP.com will be valid for the period stated on the quotation. Customer agrees to pay interest on all past-due sums at the highest rate allowed by law.
Shipping Charges; Taxes. The prices of the item(s) ordered are displayed at IGXP.com Site and in Customers shopping Cart. The prices displayed exclude any form of taxes. All taxes and custom duties which may incurred in the process of shipment at the destination country shall be bear by the Customer. The delivery charges payable shall be calculated when Customers checkout their shopping cart from IGXP.com. IGXP.com uses third parties for the delivery of the items. Items will be delivered to address provided by the Customer. While IGXP.com takes all efforts to procure the expeditious delivery of the items to the Customer, IGXP.com does not represent or warrant that the items will be delivered to the Customer within the time frames quoted on our Site. The delivery time frames specified in Customers shopping cart are indicative only and shall not be an obligation on us or the carrier. If the Customer fails to take delivery of the items or fails to enable IGXP.com or the carrier to make delivery (whether by refusal or failure to provide any or proper instructions, authorization, information, payment etc), delivery shall be deemed to have take place upon the carrier or IGXP.com giving notice to the Customer of such delivery whereupon risk in the items shall pass immediately to the Customer. The Customer shall reimburse IGXP.com all costs and expenses (including but not limited to transport, storage and insurance charges) incurred by us as a result of your failure or refusal to take physical delivery.
Title; Risk of Loss. All physical items purchased from IGXP.com are made pursuant to a shipment contract. This means that the risk of loss and title for such item(s) pass to you upon our delivery to the carrier. Registered postage and insurance at the costs of buyers is available with all physical items sent and is highly recommended. Title to software will remain with the applicable licensor(s).
Warranties. In the case product(s) and/or items(s) sold by IGXP.com were not manufactured by IGXP.com, but in fact IGXP.com sources them from various suppliers and manufacturers for your convenience and cost-effectiveness. As such, IGXP.com does not make representations or warranties of any kind in relation to the item(s). All warranties and representations, whether express or implied (including warranties as to merchantability and fitness for purpose) are hereby excluded. However, IGXP.com will pass on manufacturer or supplier's warranty to the Customer, where available. Where the item(s) come with the manufacturer's warranty, IGXP.com recommends the Customer to take the time to review the terms of the warranty closely so that the Customer knows exactly the level of coverage that is offered.
Return Policies; Exchanges; Refunds. IGXP.com understands that in various cases after purchasing an item, not all Customers may be completely happy with their goods. IGXP.com regrets to inform Customers that IGXP.com does not allow any return or exchange once the item(s) have been deemed to be delivered to you unless defects due to manufacturing is reported within 5 days after receipt of the item(s) by the Customer. If IGXP.com makes an error and ships the wrong product, IGXP.com will replace it with the correct item if the product is in its original packaging, which means that the product must be unopened. If the product is opened IGXP.com may buy back the product if it is in mint condition. If the correct item is temporarily out of stock, IGXP.com will fill the order when the item returns to stock. If IGXP.com cannot fill the order at any time, a store credit or refund will be authorized at the Customers request. The Customer is responsible for shipping costs of all returns. Software returns are unaccepted. Defective software may be returned for exchange with the same product only. The products must be returned in the original packaging with all accessories and manuals included. Any discrepancies could result in a delay or partial forfeiture. There will be a re-boxing fee in IGXP.com's sole discretion for products not returned in the original manufacturer's packaging. If part of a product becomes defective, the full product must be returned. Due to limited stock, replacement product may not be available and cannot be guaranteed. After the return period, products will be covered by the manufacturer's warranty as applicable. All returns must be sent via UPS, Federal Express, DHL, TNT or any other courier that issues a tracking or registered control number. Before returns are shipped back to IGXP.com, a RMA number (Return Merchandise Authorization) must be assigned to that parcel from IGXP.com's Customer Support Executives. IGXP.com cannot accept parcels without RMA number. Pre-paid orders cannot be refunded.
Products. IGXP.com's policy is one of ongoing product update and revision. IGXP.com may revise and discontinue products at any time. IGXP.com will ship products that have the functionality and performance of the products ordered, but changes between what is shipped and what is described in a specification sheet or catalogue are possible. The parts and assemblies used in building IGXP.com products are selected from new and equivalent-to-new parts and assemblies in accordance with industry practices. Spare parts may be new or reconditioned. Using the technology available to IGXP.com, IGXP.com has tried it's best to ensure that the thumbnail images of the item(s) materially resemble the item(s) delivered to the Customer. Due to differences in monitors and variance in resolution setting, the colour seen on screen may not be the exact colour of the item(s). However, due to limitations beyond IGXP.com's control, IGXP.com is not responsible for any differences or non-conformity of the item(s) delivered to the Customer as compared to the images of the item(s) as shown on the Site.
Compatibility. IGXP.com strongly urges the Customer to check compatibility before ordering products. If an item is returned due to incompatibility, IGXP.com is unable to replace/refund the item.
Limitation of Liability. IGXP.com DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH HEREIN, INCLUDING ANY LIABILITY FOR PRODUCTS NOT BEING AVAILABLE FOR USE OR FOR LOST OR CORRUPTED DATA OR SOFTWARE. IGXP.com WILL NOT BE LIABLE FOR LOST PROFITS, LOSS OF BUSINESS OR OTHER CONSEQUENTIAL, SPECIAL, INDIRECT, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY EXCEPT AS EXPRESSLY PROVIDED HEREIN. CUSTOMER AGREES THAT FOR ANY LIABILITY RELATED TO THE PURCHASE OF PRODUCTS OR SERVICES, IGXP.com IS NOT LIABLE OR RESPONSIBLE FOR ANY AMOUNT OF DAMAGES ABOVE THE AGGREGATE DOLLAR AMOUNT PAID BY CUSTOMER FOR THE PURCHASE(S) UNDER THIS AGREEMENT.
Service and Support. IGXP.com endeavours to provide the best customer and technical support. For end-user Customers, IGXP.com support team will attempt to handle over email and other given support methods for any problem involving products and items(s) sold by IGXP.com. However, IGXP.com support team may not be able to understand or resolve any given problem. Service offerings may vary from product to product. IGXP.com has no obligation to provide service or support until IGXP.com has received full payment for the product or service/support contract for which service or support is requested.
Headings. The section headings used herein are for convenience of reference only and do not form a part of these terms and conditions, and no construction or inference shall be derived therefrom.
